The Special marriage Act, 1954 provides for the procedure of court marriage in Noida across the country. As provided by the Act, court marriage could be solemnised between two parties irrespective of their caste, religion, race, place of birth, etc. the parties interested could apply to the marriage registrar for the same. Procedure for Court Marriage- Following procedure is provided under the Act for solemnizing court marriage in patna

  • Notice of intended marriage- a notice of the intended marriage is to be submitted to the marriage officer along with the required documents. The notice has to be submitted to the marriage officer where any one of the parties resides, at least for a period of 30 days or more.
  • Publication- afterwards, the marriage officer shall publish the notice in some part of his office, from where the notice is visible to the public.
  • A period of 30 days is provided to raise any objection against the notice of marriage from the day the notice was published in the office of the marriage officer.
  • After the expiration of the 30 day period, if no objection has been raised or the objection raised was not valid, the marriage may be solemnized.
  • In case an objection was raised, which was found to be valid by the marriage officer, the application for the court marriage would be denied, however such decision of the marriage officer could be challenged in the respective district court.
  • After the date has been provided, the parties are required to be present along with the witnesses on the date of registration.
  • After the required procedure, a marriage certificate shall be provided by the marriage officer. Such a marriage certificate is the conclusive proof of court marriage.

 Documents Required: 

  • The documents necessary to be submitted along with the application for the court marriage in pune have been provided below-
  • Application form duly filled and signed by the parties
  • Documentary evidences of date of birth of both parties
  • Receipt of payment for application form
  • Documentary evidence for the address, or the stay of parties in that particular area for a period of more than 30 days.
  • Proof of marital status of bride as well as groom- unmarried/ divorcee/ widower
  • Affirmation from the parties that they are related to each other within the degrees of prohibited relationship.
  • Passport size photos of the parties
  • Copy of divorce decree or death certificate in case either of the parties is a divorcee or a widower respectively.
